TERMS OF SERVICE AGREEMENT

This Agreement is the Terms of Service for use of the website of GoodBright, LLC, dba GoodBright Referral Agency (“GoodBright”). It is a legally binding contract between GoodBright and its website users and customers. By using the website and the services provided through the website, you accept the Terms of Service contained in this Agreement. If you do not agree to the Terms of Service or if you are under the age of eighteen, you may not use or access the website or book a cleaning service through the website.

For purposes of this Agreement, GoodBright may also mean “We”, “Us” or “Our”; “Customer” or “Client” may also mean “You” or “Your”; and “Cleaning Service Provider” may also mean “Cleaner”.

GoodBright reserves the right to amend its Terms of Service at any time. By your use of our website and services, you agree to any new or amended provisions contained in the Terms of Service that have been posted by the time of your use. Our Privacy Policy is separate from this Agreement. 

 

I. Cleaning Referral Service

GoodBright is a referral service for cleaning service providers (“Cleaners”) who clean commercial, residential, and other spaces. The Cleaner is an independent contractor who works with GoodBright. You may select a Cleaner and book a cleaning service through GoodoBright. GoodBright will confirm the booking appointment, advise the Cleaner of the booking, and facilitate payment.  

 

II. Scheduling and Confirmation

When scheduling online, you will be prompted to provide your contact information and select  a specific Cleaner. You will also be required to indicate the size of the premises to be cleaned, the number of bathrooms on the premises, and other features of the premises that may be necessary to know for booking purposes.

One of our representatives will contact you by email or by phone to confirm your appointment for a cleaning service. When booking, scheduling conflicts may occur.  Booking a cleaning service online does not automatically guarantee that you will receive an appointment for the requested day and time. The booking appointment will not be certain until you receive our confirmation. 

In order for GoodBright to keep prices low and avoid trip fees, we schedule cleaning services in an order that requires the least amount of driving time. If you need a specific time, we will do our best to meet your needs, but we cannot make any guarantees.

The Customer is expected to be present at the time the Cleaner arrives on the premises unless previous arrangements for access to the premises have been made, such as the providing of a security code or key. If the Customer is not present and the Cleaner has not been provided access, you may be charged a $100.00 lock-out fee.

The Cleaner has a 30 minute to one-hour arrival window due to unforeseen events (i.e. traffic; weather; etc) for each scheduled cleaning. If for some reason the Cleaner is going to be late, we will notify you via phone call or text as soon as possible.

 

III. Payment

Payment for services may be made via credit or debit card through the Client Portal located on the website or via phone call. GoodBright accepts all major credit and debit cards. GoodBright reserves the right to collect and retain your credit/debit card information for payment of cleaning services rendered. Your card will not be charged until after the scheduled cleaning service has been completed.

Payment Options and Discounts. We offer different cleaning payment options, depending upon the Customer’’s frequency in using the service. Customers may schedule a one-time cleaning service or a weekly, bi-weekly or monthly cleaning service. Please specify the plan selected through our Booking Portal.  Additional services are available through the Website Portal or you can call or email us for a custom quote.

If you enroll in a weekly, bi-weekly, or monthly cleaning service, you will be billed on a regular basis, and you authorize GoodBright to charge each cleaning to your credit or debit card on file once the cleaning is completed. Recurring customers will be notified of any rate changes via email.  Rate changes will also be posted on the GoodBright website. 

Financial Responsibility. You, the Customer, are personally and financially responsible for any and all outstanding costs and fees incurred for the cleaning service provided pursuant to this Agreement. This includes but is not limited to collection costs for unpaid amounts on your account, including but not limited to legal costs and attorney’s fees.

Urgency Fee. If the Customer is looking for a same day service, there may be an additional fee of $50.00.

 

IV. Refunds

We generally do not offer refunds because our business is based on providing our Customers with the highest quality service possible. However, mistakes happen. If you are unhappy with your scheduled cleaning service and something was missed in the cleaning, you may call or email us by midnight on the day the service is completed, and we will coordinate to correct the error at no additional charge to you. Any refund is totally within the discretion of GoodBright and the Cleaner, and may be provided only upon proof of unacceptable service.

 

V. Right to Refuse Service

GoodBright reserves the right to refuse or discontinue service at any time and for any reason, as permitted by law. The Cleaner may refuse to provide service if the conditions at the premises are unacceptable. Such conditions include but are not limited to the presence of dangerous weapons or dangerous individuals, filthy or hazardous conditions, extreme clutter, disconnected utilities, aggressive pets, rodents, or insect infestations.  

If the Cleaner must cancel the cleaning service because the conditions at the premises are unacceptable, as outlined above, or the Cleaner feels intimidated, unsafe, or endangered, you may be charged a $100.00 cancellation fee.

 

VI. Cancellations

24-Hour Notice. You, the Customer, must provide a minimum 24-hour notice if you cancel or reschedule your cleaning service appointment. The notice must be provided to GoodBright via email, phone call, or text message.

Cancellation Fee. Failure to provide the minimum 24-hour notice of a cancellation or reschedule may result in a $100.00 cancellation fee, which will be charged to your debit or credit card on file.

Lock-outs. If upon arrival for a scheduled cleaning, the Cleaner is unable to gain entrance to the premises or is refused entrance for a scheduled cleaning, you may be charged a $100.00 cancellation fee, which shall be charged to your debit or credit card on file.

 

VII. Security and Alarms

Access. By scheduling a cleaning service, you are granting the Cleaner access to your home or premises to conduct the scheduled cleaning service.

Security Systems. If your home has a security system, please notify GoodBright in advance of the cleaning service. If instructions or a code for operating the security system are not provided, the system must be in the “off” position upon the arrival of the Cleaner. Please notify us immediately if the security code changes in order to prevent a lock-out fee.

Keys. GoodBright is not responsible for any damages or theft to the Customer’s home if the Customer chooses to leave a door unlocked or places a key in an unsecured location to provide access to the Cleaner.

Upon termination or cancellation of a cleaning service, the Cleaner shall return all customer keys in their possession within 48 hours or the next business day.

 

VIII. Utilizing Customer’s Equipment

If the Customer requests that the Cleaner use the Customer’s cleaning equipment, GoodBright and its owners, employees, or agents are not liable or responsible for the equipment’s maintenance and are not liable for any damages that may occur as a result of the use of the equipment. In addition, if your equipment is inoperable at the time the Cleaner arrives for a scheduled cleaning, the Cleaner will be unable to perform necessary work unless permitted to use their own equipment.

 

IX. Special Cleaning Instructions

Green Cleaning Supplies. Please notify us prior to the cleaning service if you require the Cleaner to use exclusively green cleaning solutions or any other solutions you use for health reasons.

Personal Cleaning Supplies. If you desire that the Cleaner use your personal cleaning supplies, please have the supplies readily available. This will allow the Cleaner to complete the cleaning as efficiently as possible.

What The Cleaner Cannot Clean. The Cleaner will not remove or clean mold or other hazardous materials. In addition, the Clean will not clean hoarding homes or places involving bodily fluids, blood, feces, vomit, cat litter boxes, bird cages, urine, or excrement from animals or humans.

Limited Liability. GoodBright and its owners, employees, representatives, and agents are not liable or responsible for cleaning products and materials provided by the Customer, and shall be held harmless for any and all damages and loss arising from the Customer’s cleaning products, materials, and equipment, including but not limited to vacuums, brooms, mops, towels, cloths, detergents, and other cleaning agents.

 

X. Inaccessible Locations & Heavy Objects

Because of safety and liability concerns, the Cleaner will not climb higher than a step stool or work outside of the home or premises. If you want the Cleaner to clean behind a large appliance, furniture, art work, or other large item that weighs more than 35 pounds, you must move it before it is cleaned. 

 

XI. Breakage and Loss

All Cleaners who are booked through GoodBright are professional. In addition, they are insured and take reasonable precautions when cleaning your home or premises. If property damage or breakage does occur or property is lost during a cleaning, such damage or loss must be reported to GoodBright via email or phone within 24 hours of the time the cleaning is completed. 

Limited Liability. GoodBright and its owners, employees, representatives, and agents are not responsible for damages caused by the Cleaner during the cleaning of your premises.

Instructions. Fragile Goods, Artwork, Collectibles, and Family Heirlooms: These objects are expensive and may be irreplaceable. Therefore, when scheduling a cleaning service, please identify these items and specify how you would like them to be handled. In addition, you agree to lock up or otherwise secure your valuables such as jewelry, mementos, etc., prior to the cleaning service appointment.

 

XII. Non-Solicitation

During the term of this Agreement and for a period of one year immediately thereafter, you acknowledge and agree not to solicit or induce the Cleaner or any employee, agent, or affiliate of the Cleaner, or other independent contractor booked through GoodBright, to work directly for you.

 

XIII. Modification and Assignment

The Customer understands and agrees that this Agreement and their obligations herein may not be assigned, sold, transferred, or modified, without the prior written consent of an authorized representative of GoodBright.

 

XIV. Website Usage

GoodBright provides its Customers with a user-friendly platform to obtain assistance in arranging for a cleaning service. Users may visit and access our website for any legal or lawful purpose. In order to protect our intellectual property, our customers, agents, users and visitors are prohibited from:

  • Downloading, copying, or transmitting any of GoodBright’s website content without our permission;
  • Using data mining or extraction software or bots;
  • Manipulating or using framing or other navigational technology;
  • Registering, subscribing, unsubscribing, or attempting to register, subscribe, or unsubscribe any person, user, company, or anyone else for our products or services unless you have our permission;
  • Using the GoodBright website or its content for any purpose other than which it was intended, such as marketing or email campaigns;
  • Harassing, stalking, bullying, or threatening behavior towards GoodBright or its owners, employees, agents, customers or users;
  • Engaging in any behavior that might violate our rights, such as our intellectual property rights, or that of our customers;
  • Impeding or interfering with our website, its security, or our server.

 

XV. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California without regard to conflict of law provisions.  

 

XVI. Severability

If any clause or paragraph in this Agreement is found to be unenforceable or invalid under any law or statute or made invalid by an order of a court of law, the invalid or unenforceable clause shall not render the balance of this Agreement invalid; and any invalid provision shall be considered altered and interpreted as necessary so as not to affect the rest of this Agreement.

 

XVII. E-Signature  

Each party to this Agreement and any documents delivered in connection with this Agreement may be electronically signed. The parties understand and acknowledge that any electronic signature appearing on this Agreement and any other such documents are the same as a handwritten signature for the purpose of validity and enforceability.
